The National Government Constituencies Development Fund (NG-CDF) formerly Constituencies Development Fund (CDF), is a fund established in 2003 through an Act of Parliament, the CDF Act 2003. The Act was later reviewed by the CDF (Amendment) Act 2007, and repealed by CDF Act, 2013 which was subsequently succeeded by the current NG-CDF (Amendment) Act 2016 . The Fund is domiciled within the ministry in charge of national economic policy and planning, currently the Ministry of Devolution and Planning. The main purpose of the Fund is to enhance infrastructural and socio-economic development at the grass root level in order to reduce poverty by dedicating a minimum of two and half per cent (2.5%) of all National Government’s share of annual revenue towards community projects identified at constituency level by the communities. Who manages the Fund? The Fund is managed by the National Government Constituencies Development Fund Board, which is a body corporate with perpetual succession and common seal. The Board operates at national level, and comprises of the Board of Directors and a Secretariat.

Requirements for Appointment

For appointment to this grade, a candidate must have:

  1. Bachelor’s degree in Law;
  2. Master’s degree in law or any other business relevant field;
  3. Diploma in Law from the Kenya School of Law;
  4. Membership to the Law Society of Kenya;
  5. At least eight (8) years’ work experience in a busy Law Firm or a comparable organization, four (4) of which should be at supervisory management level;
  6. At least Certified Public Secretary [CPS] Part two.
  7. Certificate in a Management course lasting not less than four (4) weeks from a recognized institution.
  8. Current practicing certificate;
  9. Demonstrated professional competence and managerial capability as reflected in work performance and results;
  10. Proficiency in computer applications; and
  11. Satisfy the requirements of Chapter 6 of the Constitution of Kenya.

Duties and Responsibilities  

The Principal Legal Officer will report to the Corporation Secretary through the Manager, Legal Services and will be responsible for the following: 

  1. Ensure compliance with relevant statutory and regulatory requirements and that due regard is given to specific organizational interests;
  2. Review various legal instruments applicable to the Board with a view to ensuring their relevance and applicability to the prevailing circumstances;
  3. Ensure that Board’s operations comply with the constitution and where necessary, advice on remedial measures;
  4. Review operational and policy documents to ensure compliance with the constitution, statutes and regulations;
  5. Ensure legal and governance compliance and advice on improvement, where appropriate;
  6. Advice on undertaking legal and governance audit;
  7. Handle emerging legal challenges and where necessary, recommend mitigating measures and monitor implementation;
  8. Identify and advise the Board and management on diverse legal issues;
  9. Review and vet contractual documents and where applicable, recommend necessary amendments;
  10. Develop contractual documents between the Board and third parties;
  11. Attend to all Board Litigation matters, including preparation of pleadings, managing relationships between the Board and external lawyers, court attendances and generally protect the Board’s interests;
  12. Identify regulatory requirements and collaborate with other departmental heads with a view to ensuring enforcements of requirements;
  13. Attend to constituencies’ legal queries, advice and guide on best legal practices with a view to protecting the Board’s and the Fund’s interests;
  14. Track and report on implementation of Performance Contract targets pertaining to the department;
  15. Ensure proper liaison with other offices such as the Attorney General, Director of Public Prosecution, and Kenya Police to expedite investigations pertinent to NG-CDF;
  16. Attend to and ensure timely resolution of complaints arising from implementation of the Act; and
  17. Any other duty as may be assigned by the supervisor
